Introduction
These Terms and Conditions ('Terms') govern your access to and use of the websites, mobile games, applications and related digital services provided by PIXAMENTORY ONLINE SERVICES (OPC) PRIVATE LIMITED ('Pixamentory', 'Company', 'we', 'our' or 'us'). Together, these are the 'Services'.
These Terms apply alongside our Privacy Policy, Cookies Policy, Responsible Gaming Policy, Rules of Conduct, Fair Play Policy and Content Creation Guidelines. A game or other Service may also have product-specific terms. For GRIM, the GRIM Terms of Service apply in addition to these Terms and prevail if there is a conflict about GRIM.
By accessing or using a Service, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Services.
These Terms are an electronic record under the Information Technology Act, 2000 and applicable rules. They do not require a physical or digital signature.
Eligibility and minors
You must be at least 13 years old to use our games. A Service may set a higher minimum age because of its content, features, app-store rating or applicable law.
If you are under the age of legal majority where you live, you may use the Services only with permission from your parent or legal guardian. Where applicable law requires verifiable parental consent before personal data is processed, the relevant Service may require additional verification or restrict features until that consent is obtained.
If an age answer indicates that a player may be below the applicable minimum age, the player must not continue using that Service. Parents and guardians should supervise minors' use of online features and review the applicable privacy information and safety controls.
Accounts and security
Some Services allow an account or player profile. You must provide only the information requested by that Service and keep it accurate. Pixamentory does not require a personal mobile number unless a particular feature clearly states that one is necessary before you choose to use it.
Keep your credentials secure and do not sell, share or transfer an account. Tell us promptly at support@pixamentory.io if you believe an account has been accessed without permission.
You must not impersonate another person, create accounts through automated means, use another person's account without permission, or use an additional account to evade a suspension, restriction or enforcement action. Product-specific rules may impose additional account limits.
Licence and acceptable use
Subject to these Terms, Pixamentory and its licensors grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Services for non-commercial entertainment or evaluation.
You must not:
- copy, sell, rent, distribute or commercially exploit a Service except where our Content Creation Guidelines expressly allow it;
- reverse engineer, decompile or attempt to extract source code except to the limited extent that applicable law does not permit that restriction;
- use cheats, bots, automation, exploits, modified clients, unauthorised software or devices that interfere with gameplay, security, matchmaking or the in-game economy;
- probe, bypass or defeat authentication, rate limits, access controls, age gates, anti-cheat systems or other safeguards;
- disrupt a Service, introduce malicious code, scrape non-public information or access another user's data without authorisation;
- harass, threaten, defraud or impersonate another person, or upload unlawful, hateful, sexually exploitative, privacy-invasive or otherwise prohibited material; or
- use a Service in violation of applicable law, sanctions or app-store rules.
Standard indexing of publicly available website pages by recognised search engines is permitted. Security researchers must not access other users' data or disrupt the Services and should report suspected vulnerabilities privately to support@pixamentory.io.
Online games, safety and fair play
Our games are offered for entertainment. Unless a product expressly and lawfully states otherwise, they are online social games: players do not deposit money or other stakes in expectation of a monetary return, and gameplay rewards cannot be cashed out, sold or transferred outside the relevant game.
You must follow the Rules of Conduct and Fair Play Policy. Depending on the Service and its audience, we may use safeguards such as age gates, parental controls, reporting tools, play-time reminders, matchmaking protections, moderation and anti-cheat monitoring.
We operate our online games subject to the Promotion and Regulation of Online Gaming Act, 2025, the Promotion and Regulation of Online Gaming Rules, 2026, and other applicable law. These Terms do not represent that any game has been determined or registered by the Online Gaming Authority of India. If a determination or registration becomes legally required and is obtained, the relevant details will be displayed in the affected Service as required by law.
Virtual items and rewards
A Service may provide virtual currencies, cosmetic items, characters, consumables, entitlements or other digital content ('Virtual Items'). Names such as coins or Gems are examples of Virtual Items. Product-specific screens and rules explain what is available in that Service.
Virtual Items are licensed, not sold as property. They have no cash value, are not legal tender, cannot be redeemed for money or a monetary prize, and cannot be transferred between users or outside the relevant Service unless we expressly enable and lawfully describe that functionality.
Virtual Items may be earned through gameplay, provided as a free reward or, if a Service later enables purchases, acquired through an authorised purchase channel. These Terms do not themselves offer any Virtual Item for sale. GRIM's Phase 1 Early Access build currently does not offer in-app purchases, as explained in the GRIM Terms of Service.
Earned or promotional Virtual Items may have a disclosed usage period or other condition. A condition will be shown before the item is earned or issued. Virtual currency purchased through Apple In-App Purchase will not expire, and purchases through other app stores will receive any equivalent protection required by the applicable store or law.
We may correct a balance that resulted from a verified bug, exploit, duplicate grant, failed payment, refund or chargeback. Where reasonably practicable, we will explain the correction and provide a way to challenge an error. We will not remove legitimately acquired paid items merely because an account is inactive. Rights concerning paid items following account closure remain subject to applicable law and the relevant app store's rules.
Payments and refunds
If a Service enables a purchase in the future, the price, currency, content, renewal terms and material restrictions will be displayed before you give affirmative consent to buy. In-app purchases of digital goods will use Apple In-App Purchase or Google Play Billing unless a different method is expressly permitted by applicable law and the relevant store's programme rules.
We will not direct users to an external payment method for in-app digital goods unless that flow is permitted for the user's storefront or region and Pixamentory has satisfied the applicable programme requirements. Virtual currency purchased for one game may be used only within that game.
Refunds are handled under applicable consumer law and the rules of the store or payment provider that processed the transaction. Nothing in these Terms makes a sale final where a refund, replacement or other remedy is required by law or store policy. For a failed delivery or billing problem, contact support@pixamentory.io with the order number, but do not send full payment-card details.
The Services do not permit bets, wagers, cash stakes, cash prizes or the purchase of an opportunity to win money.
Usernames, content and communications
Multiplayer features may show your chosen username, avatar, gameplay statistics, rank and in-game achievements to other users. Choose a username and avatar you have the right to use and that comply with our rules.
You give Pixamentory a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that information only as reasonably necessary to operate, secure and promote the relevant Service. This licence ends when the information is deleted from our active systems, except for lawful retention, security records and materials already published with your permission that cannot reasonably be withdrawn. We will not sell your username or avatar as a standalone asset.
If you submit other content, the product-specific submission terms and our Content Creation Guidelines apply. Operational messages necessary to provide or secure a Service may still be sent when available. Marketing messages require the consent required by law and can be opted out of without losing access to the Service.
Website and business enquiries
You may browse and share links to public pages on pixamentory.io. Website content is provided for general information and may change.
If you send a business enquiry or project brief, you retain ownership of it and permit us to process it to assess and respond to your request. Do not send confidential information before we have signed an appropriate confidentiality agreement. Sending an idea does not prevent us from independently developing similar concepts and does not create a right to payment or credit.
Any automated estimate shown by the website is preliminary and non-binding. Professional services, deliverables, pricing and timelines are governed only by a separate written agreement signed by the relevant parties.
Intellectual property
The Services and their software, artwork, names, logos, audio, characters, worlds, text, interfaces and other content are owned by Pixamentory or its licensors and are protected by applicable intellectual-property laws. Except for the limited licence above and permissions in our Content Creation Guidelines, no rights are granted to you by implication.
Apple and Google are not responsible for investigating third-party intellectual-property claims concerning a Pixamentory application. Pixamentory is responsible for addressing such claims to the extent required by applicable law.
Enforcement and termination
We may warn a user, remove prohibited content or an improperly obtained benefit, restrict a feature, suspend an account, or terminate access when reasonably necessary to enforce these Terms, protect users or the Services, comply with law, address fraud or security risks, or respond to a serious operational issue.
Enforcement will be proportionate to the circumstances. Except where immediate action is reasonably necessary, we will provide notice and an opportunity to appeal through support@pixamentory.io. Severe cheating, payment fraud, threats, child-safety violations or attempts to compromise the Services may result in immediate restriction or termination.
You may stop using the Services at any time and may request account deletion where supported. Provisions that by their nature must survive, including intellectual-property ownership, lawful records, accrued payment obligations, consumer rights and dispute provisions, continue after termination.
Updates and availability
We may provide patches and updates for security, compatibility, legal compliance, balance or new functionality. An update may be required to continue using a Service. We may also change, suspend or discontinue a feature for legitimate technical, security, legal or business reasons.
We do not promise uninterrupted or error-free availability. Where a discontinuation materially affects a paid entitlement, we will provide any notice, continued access, substitute, refund or other remedy required by applicable law or the relevant app store.
Privacy
Our Privacy Policy explains what personal data we process, why we process it, whom we share it with, how long we keep it and how to exercise applicable privacy rights. A product-specific privacy policy may provide more precise information and will prevail for that product where it gives a more specific description.
Grievance redressal and regulatory escalation
You may report an account, content, safety concern, purchase problem, privacy issue or other complaint by contacting the Grievance Officer below. Include enough information to identify the Service, the issue and the outcome you seek, but do not send passwords or full payment-card details.
Grievance Officer
- Name: Himanshu Kumar
- Email: hello@pixamentory.io
- Registered office: 235, Sanganer Bazar, Airport Road Sanganer, Raghunath Puri 2, Sanganer, Jaipur, Rajasthan, India - 302029
- Office hours: 10:30 AM to 5:00 PM, Monday to Friday, excluding public holidays
We will acknowledge a valid complaint within twenty-four hours and aim to resolve it within fifteen days, or within another period required for the particular complaint by applicable law. Urgent reports involving child sexual abuse material, non-consensual intimate content, impersonation or an immediate threat should be clearly marked urgent and will be handled under the shorter timeline required by law.
For a grievance concerning an online social game or e-sport, if you are dissatisfied with our resolution or receive no resolution within the applicable timeline, you may approach the Online Gaming Authority of India within thirty days using the digital form published by the Authority. A further appeal may be available to the Appellate Authority under the Promotion and Regulation of Online Gaming Rules, 2026.
This process does not remove any complaint, consumer-forum, court, regulatory or other statutory remedy available to you.
Consumer rights and liability
Nothing in these Terms excludes or limits a statutory warranty, refund right, consumer remedy or liability that cannot lawfully be excluded or limited. The Services are provided on an 'as available' basis subject to those rights.
To the extent permitted by law, Pixamentory is not liable for an indirect or consequential loss that was not reasonably foreseeable when you used the Service. Pixamentory's aggregate liability arising from a Service will not exceed the greater of INR 10,000 or the amount you paid Pixamentory for that Service during the twelve months before the event giving rise to the claim.
That cap does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of a non-excludable data-protection obligation, or any other liability that cannot legally be limited.
If your unlawful conduct or deliberate breach of these Terms causes a third-party claim against Pixamentory, you are responsible for the direct, reasonable losses resulting from that claim to the extent permitted by law. This does not require a consumer to compensate us for our own breach, negligence or unlawful conduct.
Third-party services and app stores
The Services may link to third-party services. Their own terms and privacy policies apply, and Pixamentory is not responsible for their independent acts or omissions. This does not exclude responsibility where a third party acts under Pixamentory's direction or where the law makes Pixamentory responsible.
These Terms are between you and Pixamentory, not Apple or Google. Pixamentory is responsible for its applications, support and claims concerning them to the extent required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms for an application obtained through Apple where Apple's required terms provide that right. Google receives any equivalent benefit required by Google Play's applicable terms.
If an app-store rule gives you greater protection for a purchase or use of an application, that rule prevails to the extent of the conflict.
Disputes and governing law
Please first use the grievance process so we have an opportunity to resolve the issue. These Terms are governed by the laws of India.
If you are a consumer, you retain the right to approach a competent Consumer Disputes Redressal Commission and any other forum available under applicable law. Nothing in these Terms requires a consumer to arbitrate or waive a statutory remedy.
For a dispute not resolved through the grievance process, you and Pixamentory may mutually agree in writing to arbitration under the Arbitration and Conciliation Act, 1996. Unless the parties agree otherwise, the arbitration will be conducted in English by one arbitrator, with Jaipur, Rajasthan as the seat, and may be conducted remotely. Arbitration is optional unless a separate valid agreement makes it mandatory.
Subject to mandatory consumer and other statutory jurisdiction, courts with competent jurisdiction in Jaipur, Rajasthan may hear disputes arising from these Terms.
Changes to these Terms
We may update these Terms for legal, security, operational or product reasons. The 'Last updated' date identifies the current version. We will provide reasonable advance notice of a material change when required or practicable, using an in-Service notice, website notice or available contact details.
A change will apply from its stated effective date and will not retroactively remove rights that have already accrued. If you do not agree to a material change, you may stop using the affected Service before it takes effect.
Miscellaneous
These Terms and the policies and product-specific terms expressly linked from them form the agreement governing the Services. A separate signed agreement governs professional work and prevails for that work.
If part of these Terms is found unenforceable, it will be limited only as much as necessary and the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer your account or these Terms without our consent. Pixamentory may transfer these Terms as part of a merger, reorganisation or sale of the relevant business, subject to applicable notice and consumer rights.
